Transfer of Land & Freehold Property
The Registrar advises any potential buyer to search the Land Register and obtain independent legal advice.
Whilst Land Registry staff can help with undertaking searches, they cannot provide legal advice. The fees and duties currently payable on the purchase of a freehold property include registration fee and document duty. [114kb]
To register a transfer you need to lodge the required forms and fees payable with the Registrar. The forms needed are:
- Form A, the application form to change or amend the register
- Form B, the transfer form
The Form B must be witnessed by one of the following people: a member of the Land Registry staff in Alderney, a Guernsey Advocate, a Solicitor in the United Kingdom or a Notary Public in any other country.
Transfers of Land must also be accompanied by a Proof of Identity Form for both the buyer(s) and the seller(s) involved.
- An Individual person uses the Form C
- A corporate body uses the Form D
Both forms require a passport sized photo, a passport or Guernsey/UK driving licence and a recent utility bill. For the Form D the corporate body also needs to include proof of the Corporation's existence, and evidence of the individual's authority to represent the Corporation.
The Form C or D can be witnessed by one of the following people: Land Registry staff in Alderney, an Estate Agent in Alderney, a Guernsey Advocate, a Solicitor in the United Kingdom or a Notary Public in any other Country.
